Terms of Use

These Terms of Use (the “Terms”) are a binding agreement between you and Authentic Code LLC (“Authentic Code”, “we”, “us” or “our”). Please read them carefully. They limit our liability, they require you to obey the traffic laws that apply to you, and they explain how your subscription renews and ends.

1. Who we are and what these Terms cover

Ghost is published by Authentic Code LLC, a limited liability company organised under the laws of the State of Wyoming, United States, at 680 S Cache Street, Suite 100-7414, Jackson, WY 83001, United States. You can reach us at support@drivewithghost.com.

These Terms cover the mobile application Ghost: Speed Camera Detector for iOS and Android, its Apple Watch app, what it displays in Apple CarPlay and Android Auto, its widgets, Live Activities and notifications, and the website drivewithghost.com (together, “Ghost”).

2. Accepting these Terms

By downloading, installing, starting a free trial of, subscribing to or using Ghost, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Ghost.

You confirm that you are at least 18 years old, or the age of majority where you live if that is higher, and that you are legally able to enter into this agreement. If you use Ghost on behalf of an organisation, you confirm that you are authorised to accept these Terms for it.

3. What Ghost is — and what it is not

Ghost is an information service. It tells you that a known speed camera location or average-speed zone may be on the road ahead, using a licensed camera database together with your device’s position, speed and heading.

Ghost is not a navigation system and does not calculate routes. It is not a substitute for road signs, traffic signals, road markings, your vehicle’s speedometer, or your own attention and judgement. It does not control your vehicle in any way, and it never tells you how to drive. Ghost does not warn about police checks.

Ghost is an aid, not an authority. Road signs, traffic law and your own careful driving always come first.

4. Camera data and its limits

Camera locations, camera types, average-speed zones and the speed limits shown at camera positions come from a third-party database licensed from SCDB (Eifrig Media GmbH, Hamburg, Germany) and are provided on an “as available” basis. Coverage differs from country to country and changes over time.

We do not warrant that this information is complete, accurate, current or delivered in time. Cameras are added, moved and removed; temporary and mobile cameras may not be included at all; a speed limit is shown only where it is known, and it may still be wrong or out of date; and any record may contain errors or gaps.

Ghost relies on your device’s GPS and sensors to estimate your position, direction and speed. These estimates can be delayed, inaccurate or unavailable — for example in tunnels, between tall buildings, in car parks or where reception is poor — and the speed Ghost shows may differ from your vehicle’s calibrated speedometer, which remains the reference you must follow.

We do not guarantee that any particular warning will be given, that it will be given at any particular distance or time, or that Ghost will be free of false, late or missed warnings.

5. You remain the responsible driver

You are at all times solely and fully responsible for the operation of your vehicle, including your speed, your compliance with every posted limit, sign and signal, and all traffic and road-safety laws, and for driving safely for the conditions.

Keep your attention on the road. Set Ghost up before you start driving. Do not read, touch or adjust your phone, watch or car display while driving except where the law allows it and it is safe. Mount your device only in a lawful and safe position that does not block your view or any airbag. The same applies to what Ghost shows on Apple CarPlay, Android Auto and Apple Watch.

Ghost must never be a reason to drive faster, to pay less attention, or to rely on the app instead of the road in front of you.

6. Where Ghost may be used

Speed camera warning services are not lawful everywhere. In some countries, regions or situations, using — or even carrying — a device or app that warns about speed cameras is restricted or prohibited, and the rules can apply to the driver even when the app is available in that country’s store. You are responsible for knowing and obeying the law wherever you use Ghost, and you agree to switch off or stop using Ghost’s warnings wherever they are not permitted.

Without limiting that responsibility, and without any promise that we will do so in every case, Ghost adapts its behaviour to some known rules. In particular, Ghost gives no speed camera warnings inside Switzerland, where camera warning devices are prohibited, and in some countries, such as France, warnings may be given as zones rather than exact positions. These adaptations are a precaution, not legal advice, and they do not relieve you of your own responsibility.

Ghost is launched country by country, starting with the United Arab Emirates. The countries for which camera data is available depend on our data licence and may change. Ghost may be downloadable in a country for which no camera data is yet available.

You may not use Ghost if you are located, organised or ordinarily resident in any country or region subject to comprehensive United States embargoes or sanctions, or if you are named on any United States government list of prohibited or restricted parties, and by using Ghost you confirm that neither applies to you. You agree to comply with all export control and sanctions laws that apply to your use of Ghost.

We accept no responsibility for any use of Ghost that is unlawful where it takes place.

7. Availability, devices and platforms

Ghost depends on things we do not control: your device and its sensors, its operating system and settings, GPS and satellite positioning, mobile and internet connectivity, battery and power management, your vehicle, and third-party platforms. Which features are available can differ between iOS and Android, between devices and between operating-system versions.

In the car, Ghost appears on Apple CarPlay as a Dashboard tile and through system notifications, not as a full-screen map; on Android Auto it appears in the form Google permits for its category. What is shown, and whether it is shown at all, depends on your vehicle, your phone, the platform version and the rules of Apple and Google, which may change. The Apple Watch app requires a compatible, paired Apple Watch.

Operating systems may limit background operation, location access, sound or notifications, and you may have switched some of these off yourself. When that happens, Ghost may be unable to warn you. We are not responsible for interruptions, restrictions or failures caused by any of the things listed in this section.

Pre-release versions of Ghost, such as versions distributed through TestFlight or Google Play testing tracks, are provided for testing, may be incomplete or unstable, and are provided strictly “as is”.

8. Subscription, free trial, renewal and cancellation

Access requires a subscription. Ghost’s camera warnings are available only during an active free trial or paid subscription. Ghost is offered as a yearly and a monthly plan. The available plans, prices, trial length and billing periods are shown in the app and by the App Store or Google Play before you buy; Ghost never assembles a price itself. Prices differ by country, may include or exclude taxes depending on where you live, and may change; a price change is shown to you before it applies to you.

Free trial. Where a free trial is offered, it lasts for the period shown before you start it — currently 7 days. Eligibility for a trial is decided by the store and may be limited to one per person, account or household. Unless you cancel before the trial ends, it converts automatically into a paid subscription at the price shown.

Payment and renewal. Payment is charged to your Apple or Google account when you confirm the purchase or, after a trial, when the trial ends. Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.

Cancellation. You manage and cancel your subscription in your Apple or Google account settings — not inside Ghost, and not by writing to us. Deleting the app does not cancel your subscription. After cancellation, access continues until the end of the period you have paid for. Restore Purchases, on the purchase screen, recovers a subscription you already hold on a new device or after reinstalling.

Refunds. Apple and Google are the sellers of record for in-app purchases and decide refund requests under their own policies. Except where the law requires otherwise, payments are non-refundable and partial periods are not refunded. Any statutory right of withdrawal or refund you have is not affected.

When access ends. When your trial or subscription ends, is refunded, or is revoked, Ghost’s camera warnings stop and the camera data stored on your device is deleted or made unusable. Ghost regularly confirms your access with the store; if it cannot do so for an extended period (currently 14 days), for example because your device has been offline, camera data may stop working until access can be confirmed again. Our data licence requires this, and it is not a fault.

9. Family Sharing

On iOS, a subscription can be shared with the members of your Apple Family Sharing group — the subscriber plus up to five other people — where Apple makes this available and Family Sharing is enabled for the subscription. Google Play does not support sharing a subscription with family members: the subscriber can restore the purchase on their own Android devices signed in to the same Google account, but every other person needs a separate subscription. Availability and the rules that govern it are set by Apple and Google, not by us, and may differ by country. We cannot grant or restore access on another person’s behalf.

10. Your licence to use Ghost

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use Ghost on devices you own or control, for your own private and lawful use, for as long as you have access under section 8. On iOS, this licence is further limited to Apple-branded products that you own or control and to the uses permitted by the App Store Usage Rules.

You must not, and must not allow anyone else to: copy, modify or create derivative works of Ghost; reverse engineer, decompile or disassemble it, except to the extent this restriction is prohibited by law; circumvent or interfere with any security, licensing, subscription or technical protection measure; resell, rent, lend, sublicense or commercially exploit Ghost; or use Ghost in any way that is unlawful, harmful, or that interferes with its operation, its servers or anyone else’s use of it.

11. Protection of the camera data

The camera data in Ghost is licensed to us for use only inside Ghost’s speed camera warning service, and our licence requires us to protect it. You may use it only as it functions normally inside the app, for your own driving.

You must not access, copy, scrape, extract, export, harvest, mirror, reconstruct, decrypt, store outside the app, publish, share, sell or otherwise make available any camera data, in whole or in part, by any means; and you must not use Ghost or its data to build, train, test, improve or supply any database, dataset, map, machine-learning model, product or service, whether or not it competes with Ghost.

A breach of this section ends your licence immediately, may be passed on to our data provider, and may expose you to claims by us and by the rights holder.

12. Camera reports you send

Ghost lets you report a missing, moved or removed fixed camera or average-speed zone. Reporting is voluntary. A report consists of the position and time you mark, your heading and speed at that moment, the type of report, and a random installation identifier; the Privacy Policy explains this in full.

Reports are corrections to a database of permanent installations. They are sent to our camera-data provider SCDB (Eifrig Media GmbH), whose “Report Safety Cameras” programme reviews them to improve the database for all of its licensees, or, where that route is not available, to our own server. Reports are never real-time warnings: nothing you send reaches another driver’s phone as a warning, and no report creates or strengthens a warning on your own phone. Several of your own reports that a camera is gone or misplaced may mark it as doubted on your phone, but that mark never changes the tone, the ring or the distance of the warning. Reports are reviewed before they change the camera database, and a camera is not deleted on the strength of reports alone.

By sending a report, you grant Authentic Code and SCDB (Eifrig Media GmbH), and their successors and licensees, a perpetual, irrevocable, worldwide, royalty-free, transferable and sublicensable right to use, store, reproduce, modify, combine with other data, publish and distribute the report, including as part of camera databases. You confirm that each report is made in good faith, is accurate to the best of your knowledge, and is made only when it is safe and lawful to do so. There is no report category for a mobile speed check or a police patrol, and you must not use Ghost to report police checks, people, vehicles, or anything other than permanent camera installations and average-speed zones. We and SCDB may accept, change, combine or reject any report without telling you.

13. Third-party services

Ghost uses services of other companies, including Apple, Google, RevenueCat (subscription management), SCDB (Eifrig Media GmbH, camera data) and Cloudflare (our servers and website). Your use of those services is also subject to their own terms and privacy policies, and we are not responsible for them.

Google Maps. Ghost’s map screen uses the Google Maps SDK. By using it, you agree to be bound by the Google Maps/Google Earth Additional Terms of Service and acknowledge the Google Privacy Policy.

OpenStreetMap. Ghost uses road data © OpenStreetMap contributors, available under the Open Database Licence (ODbL), to tell the road you are on from the roads beside it.

Ghost works alongside navigation and other apps but is not affiliated with, endorsed by or sponsored by Apple, Google or any maker of those apps. Apple, App Store, Apple Watch, Apple Maps and CarPlay are trademarks of Apple Inc. Google, Google Play, Google Maps, Android and Android Auto are trademarks of Google LLC.

14. Our intellectual property

Ghost — including its software, design, the ghost character and the Ghost name and logo, its user interface, text, graphics and sounds, and the compiled camera and map data made available through it — is owned by Authentic Code or its licensors and is protected by intellectual-property and other laws. All rights not expressly granted to you are reserved. If you send us feedback or suggestions, we may use them freely and without obligation to you.

15. Disclaimer of warranties

To the fullest extent permitted by law, Ghost is provided “as is” and “as available”, with all faults and without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, accuracy, quiet enjoyment and non-infringement.

Without limiting the above, we do not warrant that Ghost will be uninterrupted, timely, secure or error-free; that warnings will always be given, or given correctly or in time; that camera, speed-limit or map data will be complete, accurate or current; that Ghost will work with any particular device, vehicle, operating system or third-party service; or that any defect will be corrected. No advice or information you obtain from us or through Ghost creates any warranty not expressly stated in these Terms.

16. Limitation of liability

To the fullest extent permitted by law, Authentic Code and its owners, managers, officers, employees, contractors, suppliers and licensors (including SCDB) will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, data, goodwill or opportunity, arising out of or in connection with Ghost or these Terms, however caused and on any theory of liability, even if we have been told such damages are possible.

In particular, and to the fullest extent permitted by law, we are not liable for any speeding fine, penalty, penalty points, prosecution, licence suspension or revocation, insurance consequence or other enforcement action; for any accident, collision, personal injury or death; for any damage to property or vehicles; or for any missed, late, false or inaccurate warning — whether or not it was caused by inaccurate or missing camera or speed-limit data, GPS or sensor error, device, operating-system or vehicle behaviour, loss of signal, a lapsed subscription, the rules of a third-party platform, or Ghost failing to work.

To the fullest extent permitted by law, our total aggregate liability for all claims arising out of or in connection with Ghost or these Terms will not exceed the greater of (a) the amount you paid for Ghost in the twelve months before the event giving rise to the claim, or (b) ten US dollars (US$10). These limitations apply even if a remedy fails of its essential purpose, and they allocate risk between you and us as a basis of the price of Ghost.

17. Indemnification

To the extent permitted by law, you agree to indemnify, defend and hold harmless Authentic Code and its owners, managers, officers, employees, contractors, suppliers and licensors from and against any claims, damages, losses, liabilities, penalties and expenses (including reasonable legal fees) arising out of or in connection with your use or misuse of Ghost, your breach of these Terms, your driving, any report you send, or your violation of any law or of the rights of any third party.

18. Your mandatory rights

Nothing in these Terms excludes or limits any right or remedy you have that cannot lawfully be excluded or limited, including mandatory consumer-protection rights and statutory guarantees that apply where you live, or our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law. Where the law of your country gives you rights these Terms would otherwise restrict, that law prevails to the extent of the conflict, and the rest of these Terms continue to apply. Some jurisdictions do not allow certain disclaimers or limitations, so some of sections 15 to 17 may not apply to you in full.

19. Changes, suspension and termination

Changes to Ghost. We may add, change or remove features, change the countries for which camera data is available, or suspend or discontinue Ghost or any part of it, at any time, including where our data licence, a platform’s rules or the law require it. Where a change materially reduces what a paying subscriber receives, we will tell you in advance where we reasonably can, and your rights under the store’s refund policies and the law are not affected.

Changes to these Terms. We may update these Terms from time to time. We will change the version and effective date shown above and, for a material change, tell you in the app before it applies to you, where required asking you to accept the new version. If you do not agree to a change, stop using Ghost and cancel your subscription. Continuing to use Ghost after a change takes effect means you accept it.

Suspension and termination. You may stop using Ghost at any time. We may suspend or end your access, including remotely disabling the camera data on your device, if you breach these Terms, if you use Ghost unlawfully, if we must do so to comply with the law or our data licence, or to protect Ghost, its users or third parties. On termination your licence ends, and the sections that by their nature should survive — including sections 11, 12 and 14 to 20 — continue to apply.

20. Governing law and disputes

These Terms and any dispute or claim arising out of or in connection with them or with Ghost are governed by the laws of the State of Wyoming and the applicable federal laws of the United States, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Before bringing a claim, you and we each agree to try in good faith to resolve the dispute informally for at least 30 days, starting with a written notice to the other party that describes the claim; you can send yours to support@drivewithghost.com.

Subject to your mandatory rights, the state and federal courts located in Wyoming have exclusive jurisdiction over any dispute that is not resolved informally, and you and we consent to their jurisdiction. Either party may instead bring an individual claim in a small-claims court where it qualifies. To the extent permitted by law, you and we each waive any right to a jury trial and agree that claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative action.

If you are a consumer, this choice of law and forum does not deprive you of the protection of the mandatory laws of your country of residence or of your right to bring proceedings in its courts where that law gives you that right.

21. Additional terms for the Apple App Store

If you obtained Ghost from the Apple App Store, the following also applies, and it prevails over anything else in these Terms to the extent of any conflict:

• These Terms are concluded between you and Authentic Code only, not with Apple Inc. (“Apple”). Authentic Code, not Apple, is solely responsible for Ghost and its content.
• Your licence is limited as described in section 10, including to use on Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Ghost may be accessed by other accounts associated with you through Family Sharing.
• Apple has no obligation whatsoever to provide any maintenance or support services for Ghost.
• If Ghost fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Ghost, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are, as between Apple and us, our responsibility, subject to the disclaimers and limitations in these Terms.
• Authentic Code, not Apple, is responsible for addressing any claims by you or a third party relating to Ghost or your possession or use of it, including product-liability claims, any claim that Ghost fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection, privacy or similar laws.
• If a third party claims that Ghost or your possession and use of it infringes that third party’s intellectual-property rights, Authentic Code, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a United States Government embargo or designated by the United States Government as a “terrorist supporting” country, and that you are not listed on any United States Government list of prohibited or restricted parties.
• Questions, complaints or claims about Ghost can be sent to Authentic Code LLC, 680 S Cache Street, Suite 100-7414, Jackson, WY 83001, United States, support@drivewithghost.com.
• You must comply with any applicable third-party terms when using Ghost, such as your mobile-network agreement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

22. Additional terms for Google Play

If you obtained Ghost from Google Play, your purchase is also subject to the Google Play Terms of Service and Google Play’s payment and refund policies. Google is not a party to these Terms and is not responsible for Ghost.

23. General

These Terms, together with the Privacy Policy and any terms shown to you in the app at the point of purchase, are the entire agreement between you and Authentic Code about Ghost and replace any earlier agreement about it. If any provision is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign or transfer these Terms without our written consent; we may assign them to an affiliate or to a successor to our business. We are not liable for any failure or delay caused by events beyond our reasonable control. We may give you notices in the app, by email if you have given us your address, or on this website. Section headings are for convenience only. These Terms are written in English; if we provide a translation, the English version prevails to the extent permitted by law.
